The analysis goes beyond the scope of this\nnewsletter and in case of request, we gladly provide you further information on\nessential content.<\/em><\/p>\n\n\n\n<p><strong>1. &nbsp;&nbsp;&nbsp;&nbsp;&nbsp; THE CURRENT\nRULES FOR USE OF COMPUTER EQUIPMENT PROVIDED BY THE EMPLOYER<\/strong><\/p>\n\n\n\n<p>The Section 2 of Art 197 of the Act I of 2012 on the Hungarian Labour Code\n(hereinafter: the \u201c<strong>Labour Code<\/strong>\u201d) regulates the use of computer devices by the\nemployee on private purposes in the following way:<\/p>\n\n\n\n<p><em>\u201eThe employer may\nrestrict the use of computing equipment or electronic devices in a way, that it\nsupplies solely to the work of the employee performed on its behalf.\u201d<\/em><\/p>\n\n\n\n<p>Based on this fact, the employee is entitled to use the computer devices\nfor private purposes as well, if the respective labour contract, or other company\nregulation\/internal policies are not containing any special regulation in this\nmatter.<\/p>\n\n\n\n<p><strong>2. &nbsp;&nbsp;&nbsp;&nbsp;&nbsp; THE RULES\nRELATED TO THE PROPOSAL LAID BY THE MINISTER OF JUSTICE<\/strong><\/p>\n\n\n\n<p align=\"justify\">The possible forthcoming\nchange of the Labour Code recently filed under nr. T\/4479 by the Minister of\nJustice to the Hungarian Parliament revers the regulation of the Labour Code, as\nthe following: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Under the new regulation, unless otherwise agreed by the parties, the\nemployee may not use the computer equipment, tools (pc, notebook, smart -, mobile\nphone etc.) provided by the employer for work purposes for any private purpose.\n(Currently the opposite is the case.)<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Based on this rule, the employer may check compliance with the abovementioned\nprohibitions, though during the controlling process the employer is restricted\nfor the purpose of reviewing employment relationship related data.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>On the other hand, control check performed on private employee data it is strictly\nprohibited. However, any data necessary for the verification for compliance shall\nbe deemed to be employment-related data based on presumption of the law.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>The rules on control check shall apply in all cases when, based on the\nagreement of the respective parties, the employee uses own computer device, or tools\nfor the purposes of fulfilling the respective employment relationship.<\/li><\/ul>\n\n\n\n<p>Once the proposal is accepted,<\/p>\n\n\n\n<p>(i) There might be a need to modify labour contracts of the employees, to regulate whether the private use of computing devices (computers, mobile phone, etc) of the employer are allowed, and <\/p>\n\n\n\n<p>(ii) The rules of private usage,\nplus the control for compliance with the abovementioned provisions possibly set\nas internal stated policy.<\/p>\n\n\n\n<p>*<\/p>\n\n\n\n<p><em>This summary intends to raise awareness and does not constitute legal\nadvice.<\/em><\/p>\n\n\n\n<p><em>If you might have any question or need further information, please do not\nhesitate to contact us.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>We are hereby presenting the amendments of the Hungarian Labour Code.
